RECOMMENDATION:

Approve Ordinance # 18-01, amending Title 6 Animals of the Valdez Municipal Code. Second Reading. Adoption.

 

SUMMARY STATEMENT:

Title 6 regarding animals required the establishment of a fine schedule to comply with statutory requirements. During this process the entire ordinance language in Title 6 was reviewed by legal, Chief Hinkle, Animal Control staff and the City Clerk. Proposed amendments to the ordinance language are illustrated in redline/strikeout format.

The majority of amendments simply move existing language into the proper order within an applicable chapter and section.  While administration intends to discuss each section of the ordinance during public hearing, the most notable revisions are as follows:

1.                     Established fine schedule based on existing violations.

2.                     Removed the requirement of a mandatory court appearance for the citation issued for “Running at large”.

3.                     Included language related to crating of animals.

4.                     Removed “fancier facility” as the definition did not warrant a section separate from a kennel license.

5.                     Increased the number of days an animal must be held by the shelter prior to disposal by the animal control officer. The Valdez animal shelter practice is to hold animals in excess of this time period to assure adoption, however based on statute language it is prudent to establish a minimum in code.
