RECOMMENDATION:

Approve Resolution No. 17-52, Authorizing a Snow Storage Agreement with the State of Alaska Department of Transportation and Public Facilities (ADOT/PF) for Block 5 of Block 20, Mineral Creek Subdivision, Addition No. 2 and Tract B of Block 6 of Block 20, Mineral Creek Subdivision, Addition No.2.

 

SUMMARY STATEMENT:

This resolution authorizes a five-year snow storage agreement with ADOT/PF for two parcels adjacent to Hazelet Avenue. See attached map for parcel locations. The State of Alaska is responsible for the snow removal on Hazelet Avenue and relies on this agreement for convenient snow storage.

 Valdez City Council first approved a five-year snow storage agreement with ADOT/PF in October of 1992 for a portion of Block 5 of Block 20, Mineral Creek Subdivision (MCS) Addition No. 2. In November of the same year an amendment was passed to increase the area for use to include all of Block 5 of Block 20, MCS, Addition No. 2 and Tract B of Block 6 of Block 20, MCS, Addition No. 2 (the same area in the current proposed agreement.) There is no record of amendment or extension of the original agreement from the expiration in 1997 until September of 2005, when a new agreement was signed.

 The term of the 2005 agreement was five years, ending September 11, 2010. In January of 2011, a new five year agreement was approved by council and signed by Mayor Cobb. This agreement expired on December 31, 2016.

This November, it was brought to staff’s attention that this agreement should be renewed to ensure that the state has appropriate area to store snow this winter season. Staff contacted Robert Dunning, Valdez District Supervisor for ADOT/PF, to verify that the agreement should be renewed. He confirmed that the property within this agreement is essential for the State’s snow removal work on Hazelet Avenue.

The attached agreement includes the same language as the previous snow storage agreement. It is dated to begin January 1, 2017 to prevent a lapse in the agreement, per the advice of legal counsel, and will end on December 31, 2022. There is no fee to the State of Alaska for the use of this property for snow storage. Either party may end the agreement at any time with a minimum of 90 days notice given to the other party. This allows for the City to reevaluate, should the property be needed for an alternative use.

Rob Comstock, Public Works Director, and his streets foreman have reviewed this agreement document and had no objection to anything within its content. Comstock mentioned in his comments that “it is definitely in the City’s best interest to accommodate the State in this instance. Historically the State has been a great partner in our snow removal efforts and they have done a good job of taking care of these snow lots.”
