SUMMARY STATEMENT:
The City of Valdez received notification from the State of Alaska Alcohol & Marijuana Control Office of the approval and intent to issue a retail marijuana store license to Herbal Outfitters, LLC. A local government may protest the approval of an application by furnishing the director and the applicant with a clear and concise written statement of reasons for the protest within 60 days of the date of notice.
3 AAC 306.010 (c) provides that the board will not issue a license when a local government protests an application on the grounds that the applicant's licensed premises are located in a place within the local government where a local zoning ordinance prohibits the marijuana establishment, unless the local government has approved a variance from the local ordinance.
The Community Development Department has reviewed the license application and concluded that the location of Herbal Outfitters, LLC is located within the CDB Central Business District which allows a retail marijuana store as a permitted principal use.
The applicant has certified in his application to the State that the premises is not within 500 feet of a school ground, recreation or youth center, a building in which religious services are regularly conducted, or a correctional facility, as set forth in 3 AAC 306.010(a) (attachment MJ-00). Mr. Ballow (applicant) provided with his application a google earth map which identifies the location of the entrance to his building and surrounding buildings (attachment MJ-02).
