RECOMMENDATION:

The City Council ("Council") should determine whether or not a negotiated sale of this parcel to Rydor Enterprises, LLC ("Rydor Enterprises" or "Applicant") is in the public's best interest. When looking at a negotiated sale, we have to consider if the property would be useable or desirable to anyone else, or if it is appropriate for the transaction to only be discussed between the City and the Applicant. If the Council decides that a public sale, such as via auction or sealed bid, is not in the public interest, they should move to approve this negotiated sale request. Otherwise, no such approval is advised.

Planning department staff does not recommend in favor of this land sale because of the following reasons:
1) The proposed development is not in conformance with the comprehensive plan and there is no master plan for this area.
2) No agreement with AK DNR for lease of adjoining land for recreation area has been obtained nor has Rydor Enterprises made any earnest attempt to acquire such agreement, which was the purpose of selling city land to Rydor Enterprises in 2007.
3) No development plan or feasibility study of proposed project has been submitted.
4) The entire area is zoned heavy industrial, and the proposed development is not a compatible use within this zoning designation.
5) Access to the property is currently over a 4 wheel drive only trail, and in order to bring it up to city standards, it will require a large amount of capital improvement investment. The City has not identified this area as a priority.
