Approval to Conduct the Public Hearing and Action to Approve Rezone Application #19-01 for the Copper Valley Electric Association for a Portion of ASLS 79-94, 1570 Dayville Road from the Unclassified Lands Zoning District to the Public Lands Zoning District on June 26, 2019

RECOMMENDATION:

To approve to conduct the public hearing and make a recommendation on the requested rezone from the Unclassified Lands Zoning District to the Public Lands Zoning District on a portion of ASLS 79-94, 1570 Dayville Road, submitted by Copper Valley Electric Association at the June 26, 2019 Planning and Zoning Commission meeting.  This decision may be postponed if new information or testimony is presented during the public hearing that makes it difficult for a decision this evening. Staff will follow up on any new information that is presented this evening if the Commission deems necessary.

SUMMARY STATEMENT:

Due to a last minute lack of quorum at the regularly scheduled Planning and Zoning Commission meeting on June 12, 2019 this public hearing has been rescheduled for the June 26, 2019 meeting. Because of this postponement the City of Valdez Clerk’s Office has agreed that the applicant, CVEA, may pursue a decision at the same meeting as the public hearing.  The Policies and Procedures of the City of Valdez Planning and Zoning Commission state “an issue discussed in a public hearing may not appear as an agenda item for decision at the same meeting except with consent by the majority of the Commission.”  Usually a decision of the type must be made at a previous Planning and Zoning Commission meeting and should only be granted in extenuating circumstances.  Because of the postponement of the public hearing the Clerk’s Office has authorized that the decision may be made to vote on combining the public hearing and decision may be voted on tonight.

A vote of approval will allow the decision on Rezone #19-01 to be made at tonight’s meeting. If the Commission has any questions resulting from the public hearing tonight the decision can be postponed to the next meeting on July 10, 2019 to allow staff to follow up on any new information or questions.
