SUMMARY STATEMENT:
This item was postponed from the meeting of November 1, 2016 with a request by the city council for the city clerk to contact the State Alcohol Control Office to obtain a more detailed drawing of the premises which depicts where the actual brewing of alcohol will take place. Council expressed concern that the establishment did not meet the definition of a brewery as defined by State regulations.
I contacted the State Alcohol Control Office and after numerous requests for clarification I was forwarded the attached email correspondence between the State and the applicant. As of today, I have not received the new premises diagram.
The State of Alaska Alcohol & Marijuana Control Office has received an application for a brewery license from Valdez Brewing Company LLC. I have attached the application for your review.
A local governing body may protest the approval of application by furnishing the director and the applicant with a clear and concise written statement of reasons for the protest within 60 days of receipt of the notice, and by allowing the applicant a reasonable opportunity to defend the application before a meeting of the local governing body.
The Valdez Brewing Company is planning to be located at 101 Hazelet Avenue. This address is located in the General Commercial zoning district. Lisa VonBargen, Community Development Director, has advised that this zoning district does not provide for the use - brewery. That being said, the Planning & Zoning Commission has had discussions regarding the need to add this use to the zoning code. The City is preparing an ordinance to amend the Valdez Municipal Code to allow for breweries in the Central Business and General Commercial zoning districts. That ordinance is expected to be through the process in December, 2016. This application is scheduled for the early December (TBA) Alcoholic Beverage Control Board Meeting.
