RECOMMENDATION:
Approve Final Plat of South Harbor 2016 Subdivision.
SUMMARY STATEMENT:
Tract E is leased to Silverbay Seafoods Inc by the City of Valdez. Per Resolution #16-14 signed on May 4th, 2016, the City of Valdez authorized the vacation of the existing outfall utility easement and granted new outfall, electric, and utility easements within Tract E.
As required by Section 3 of Resolution #16-14, Silverbay Seafoods has conducted a survey and re-plat to delineate new easements and vacate the existing easements.
This plat has been prepared at the sole expense of Silverbay Seafoods to meet the requirements as set by the City of Valdez.
Staff has requested the following minor correction from the Surveyor prior to printing of the final mylar:
¨ Correct Plat No. on Lot 1, ATS 621 Subdivision to Plat No. 16-4
¨ Correct labeling of the northern easement of the plat to 20ft
¨ Add the name Mayor Ruthie Knight under Certificate of Ownership and Dedication
Notice was sent to all property owners within 300 feet of the property per Section 16.04.090 of the Valdez Municipal Code on November 9th, 2016.
16.04.090 Notification requirements.
A. A notice shall be sent by mail at least ten days prior to the first scheduled meeting of the Planning and Zoning commission to consider the preliminary plat approval to each owner of property within a distance of three hundred feet of the exterior boundary of the lot or parcel described in the application for subdivision.
B. Consideration of Evidence. The Planning and Zoning Commission shall hear and consider evidence and facts from any person during preliminary and final plat approval or written communication from any person relative to the matter. The right of any person to present evidence shall not be denied for the reason that any such person was not required to be informed of such subdivision of land.
Staff received one comment from an adjacent land owner to correct a mislabeled parcel identification. The error was corrected on the preliminary plat and the adjacent land owner notified.
Staff received comments from both Copper Valley Electric and Copper Valley Telecom to show the 20 foot easement on the north end of the parcel. The final plat has been corrected to show the easements and both utility companies have been notified of the correction. Staff has not received any other comments on the subdivision.
The Planning & Zoning Commission approved the preliminary plat (SUBD #16-08) of South Harbor 2016 Subdivision on November 22nd, 2016. The P&Z Commission approved the final plat (SUBD #16-08) of South Harbor 2016 Subdivision on December 14th, 2016.
Because this land is owned by the City, the Council must confirm final plat approval. Administration recommends approval of this plat.
Please note the plat actually shows “preliminary” on it. This is the final plat. This particular surveyor prefers to leave “preliminary” on the document until final plat is approved. Then the change is made.
